MASTER TERMS OF USE

By purchasing, accessing or participating in any MCC Education product, service, membership, tool or experience (collectively, the “Services”), you (“Client”, “Participant”, or “User”) agree to be bound by these Master Terms of Use and any applicable Product Addendum below. These Terms are legally enforceable and protect both you and MCC Education.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) that cannot be excluded, restricted or modified.


1. SCOPE & STRUCTURE

1.1 These Master Terms apply to all MCC Education offerings unless expressly superseded by a Product Addendum.
1.2 The relevant Product Addendum controls only where it differs expressly; otherwise, both apply together.
1.3 By proceeding with payment or accessing any content, you confirm you have read, understood, and agree to be legally bound by the Master Terms and any Product Addendum(s) applicable to your purchase.


2. INTELLECTUAL PROPERTY, LICENCE & PROHIBITED USES

2.1 Ownership. MCC Education (and/or its licensors) retains all intellectual property rights (including copyright, trade marks, trade secrets and know-how) in and to all materials provided in connection with the Services, including videos, modules, audio, written documents, downloads, community materials, templates, prompts, sales copy, digital tools, and proprietary systems or processes. No ownership transfers to you.
2.2 Licence. Upon purchase, we grant you a limited, revocable, non-exclusive, non-transferable licence to use the content for your personal or internal business use only, as permitted by these Terms and the applicable Product Addendum.
2.3 Prohibited uses (without prior written consent). You must not:

  • Copy, edit, distribute, reproduce or publicly share content beyond what is permitted;

  • Share content with anyone who has not purchased the Service;

  • Claim authorship of MCC Education content;

  • Incorporate content into products, programs or trainings for resale;

  • Use content for client delivery, team-wide implementation or corporate training without a separate licence;

  • Share login credentials or purchased materials with any other person/entity.
    2.4 Enforcement. We may monitor unauthorised use. Breach may result in immediate access revocation without refund and pursuit of all available remedies.
    2.5 Access limitations. Unless expressly authorised:

  • All Services are licensed for one individual;

  • Credentials must not be shared;

  • Multi-user/corporate licences require a separate agreement;

  • Purchasing with intent to resell or distribute access is prohibited.
    2.6 Complimentary access. Any gifted/complimentary access is non-transferable, may be revoked for misuse, inactivity, or breach, may exclude paid-level support/bonuses/updates unless stated, and may expire on a stated date unless purchased.


3. PRICING, TAXES & PAYMENT

3.1 Currency & GST. All pricing is in AUD. Prices are GST-inclusive unless otherwise stated at checkout.
3.2 Payment authorisation. By purchasing, you authorise charges per the payment terms shown at checkout and/or in the Product Addendum. Payments are processed via secure third-party processors; you must keep billing details current.
3.3 Payment plans. If you select a plan:

  • All instalments must be paid in full, regardless of participation or satisfaction;

  • You authorise automatic charges per the agreed schedule;

  • Failed payments must be remedied within 5 calendar days of notice. We may suspend access after two failed attempts and refer amounts to collections; suspension does not cancel your obligation to complete the plan.
    3.4 No set-off. You may not withhold or set off payments for any reason unless required by law.
    3.5 Chargebacks. Before any chargeback, you must email the support email listed on your receipt or our website and allow 7 business days for resolution. Where Services have been provided as described, we may dispute chargebacks and seek recovery of associated costs.
    3.6 Your taxes/fees. You are responsible for any bank fees, currency conversion fees (if any), and local taxes other than Australian GST we collect at checkout.


4. REFUNDS

4.1 General policy. Unless a Product Addendum expressly offers a specific guarantee, all sales are final and non-refundable, subject to your rights under the ACL.
4.2 Conditional guarantees. Where offered, eligibility conditions (e.g., completing coursework, attending/viewing calls, submitting proof of implementation by deadlines) will be set out in the relevant Addendum and must be met in full.
4.3 Non-qualifying situations. Refunds are not available for change of mind, personal circumstances, non-participation, or dissatisfaction where deliverables match the description, except as required by the ACL.
4.4 Payment plan obligations. If a refund request is denied, you remain responsible for all remaining instalments.


5. ACCESS & DELIVERY

5.1 Delivery methods. Services may be delivered through live sessions (e.g., Zoom), recorded modules, digital portals (e.g., Kajabi), and downloadable materials. We may change delivery methods or platforms provided core content remains accessible during the stated access period.
5.2 Access timelines. Unless otherwise stated:

  • Digital products include at least 6 months’ access from purchase;

  • Memberships remain accessible only while payments are current;

  • Cohorts may have time-limited replay/portal windows;

  • “Lifetime access” refers to the life of the program while actively offered and supported by MCC Education (see 6.5).
    5.3 Recordings. Where live sessions are recorded, details of replay availability/expiry are provided in onboarding or the Addendum. We are not responsible for third-party platform outages.
    5.4 Updates/retirements. We may update, replace or retire materials at any time. If a Service is retired, any guaranteed/lifetime access ends upon retirement, with at least 30 days’ notice to affected participants where practicable.


6. THIRD-PARTY PLATFORMS & DEPENDENCIES

6.1 Many Services rely on third-party platforms/tools (e.g., Kajabi, Zoom, Slack/Communities, ManyChat, Instagram/Meta, Vimeo, Google Drive).
6.2 We are not responsible for third-party downtime, policy changes, account restrictions, or removed features. If a platform change affects delivery, we may transition to an alternative, provide an equivalent resource, or retire the affected component without refund, provided core deliverables remain available for the access period.
6.3 Your use of third-party platforms is subject to their terms and privacy policies.
6.4 APIs/integrations. We do not guarantee integrations will remain functional indefinitely.
6.5 Lifetime access & hosting. Lifetime/extended access depends on the continued availability of the hosting platform. If discontinued, we may provide an alternative at our discretion but are not obliged to recreate/host retired materials in perpetuity.


7. AI-ASSISTED MATERIALS

7.1 Some Services incorporate AI or machine-learning tools (ours or third-party).
7.2 Unless stated otherwise, MCC Education retains IP in AI prompts, templates, workflows and training materials. You may use AI outputs for your personal/internal business use only; you may not resell, repackage, redistribute, or use them to train other AI without written consent.
7.3 Accuracy & limitations. AI outputs may be incomplete, outdated or contain errors and are not professional, legal, financial, medical or mental-health advice. You must review outputs for accuracy and applicability.
7.4 Compliance. Do not input sensitive personal information or confidential data into AI tools. You are responsible for compliance with privacy, IP, advertising and platform rules.
7.5 Liability. We disclaim liability for damages arising from AI outputs or your implementation, subject to non-excludable rights under the ACL.


8. PRIVACY & DATA

Our Privacy Policy (Australia) explains how we collect, store and use personal information in accordance with the Australian Privacy Principles (APPs). By using our Services, you consent to:
(a) Receiving email communications (you can unsubscribe at any time);
(b) Use of cookies/pixels/analytics;
(c) Secure storage of account and transaction info;
(d) Limited overseas disclosure where third-party platforms store data outside Australia.


9. TESTIMONIALS, RECORDINGS & PUBLIC COMMENTS

By participating in any program/community/call, you agree that feedback, comments, posts, messages or statements you make may be recorded and used by us for marketing or educational purposes. You grant MCC Education a worldwide, perpetual, royalty-free licence to use, reproduce, edit and publish such content (including your name and likeness, unless you request otherwise in writing prior to publication). Group settings should not be considered private.


10. COMMUNITY STANDARDS

Treat participants and staff with respect and confidentiality. Prohibited conduct includes harassment, discrimination, defamation, threats, unlawful content, IP infringement and unsolicited pitching/spam. We may remove participants who breach these standards without refund.


11. DISCLAIMERS & NO GUARANTEES

11.1 All Services are for educational/informational purposes. They are not legal, financial, medical, or other professional advice.
11.2 We do not guarantee specific results or earnings. Examples/testimonials are illustrative only.
11.3 You are responsible for your decisions and compliance with applicable laws.
11.4 Third-party references are provided “as is.”


12. LIABILITY (AUSTRALIA)

12.1 ACL. Nothing in these Terms limits your non-excludable rights under the ACL. For goods/services that are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for a failure to comply with a consumer guarantee is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
12.2 Indirect loss. To the maximum extent permitted by law, we are not liable for indirect, consequential, special or punitive losses (e.g., lost profits, revenue, data, or business interruption).
12.3 Cap. To the maximum extent permitted by law, our aggregate liability for claims relating to a Service is limited to the amount you paid for that Service.


13. GOVERNING LAW & DISPUTE RESOLUTION (AUSTRALIA)

13.1 These Terms are governed by the laws of Western Australia.
13.2 If a dispute arises, the parties will first attempt good-faith resolution in writing.
13.3 If unresolved within 21 days, either party may refer the dispute to mediation under the Resolution Institute Mediation Rules (venue: Perth, WA, or via video conference).
13.4 If still unresolved, the courts of Western Australia have non-exclusive jurisdiction.
13.5 Each party bears its own legal costs unless a court orders otherwise.


14. CHANGES TO TERMS

We may update these Terms and any Product Addendum to reflect service, legal or operational changes. Material changes (e.g., refund/dispute provisions) will be notified via email and/or prominent notice within the platform. Changes take effect when posted unless stated. Continued use constitutes acceptance.


15. CONTACT

For support, billing and program questions, please use the support email listed on your receipt or on our website so we can track and respond. Typical response times are 2–3 business days (AWST), excluding Australian public holidays.


PRODUCT ADDENDA

Each Addendum below forms part of, and is governed by, the Master Terms.


A. MCC Digital Resources (Mrs Chalmers’ Cherubs / downloads, templates, printable materials)

Overview. Instant-access digital teaching resources and templates sold via our site and/or marketplaces (e.g., Teachers Pay Teachers).
Refunds. All sales are final for digital downloads once access is provided, except as required by the ACL (e.g., major failure). If you experience a technical issue, contact support promptly for a replacement download.
Licence. Single-user classroom or internal business use only unless a multi-licence is purchased (where available). No redistribution, resale, or sharing.


B. Six-Digit Teacher (program/course; live or self-paced)

Overview. A business-education program for educators building TPT/digital product businesses. Delivery may include video modules, workbooks, live/coaching calls, and community, as described at checkout.
Payment plans. As displayed at checkout (AUD).
Access.

  • Self-paced purchases include “lifetime of the program” access to core course materials while the program is offered and supported.

  • Cohort/live components (calls, communities) may be time-limited as stated in onboarding.
    Refunds/Guarantee. Unless a specific guarantee is offered at checkout, all sales are final, subject to ACL. If a conditional guarantee is offered, eligibility will require timely completion of set work and proof of implementation by the stated deadline.
    IP use. Prompts, templates and frameworks are for your personal business only and may not be repackaged or used to train AI without written permission.


C. Six-Digit Socials (Templates & Trello Boards) / Content Kickstart / other low-ticket digital toolkits

Overview. Instant-access digital templates/boards aimed at social media execution and marketing.
Access. Access details (e.g., Trello invites, downloads) provided on purchase.
Refunds. All sales are final for low-ticket digital products, subject to ACL.
Licence. Single user. Not for agency-wide/client deliverables without a separate licence.


D. Six-Digit Collective (membership)

Overview. Subscription membership with educational resources, group calls, community and periodic templates/resources. Inclusions may change to improve the program.
Billing & renewal. Monthly or annual auto-renewal in AUD at the rate shown at checkout. You can cancel any time before your next renewal date; cancellations take effect at the end of the then-current paid period. No pro-rata refunds for partial periods, subject to ACL.
Payment failures. Access may be paused until brought current; accounts overdue 60+ days may be terminated and must re-enrol at the current rate.
Guarantee. Unless a specific guarantee is advertised at purchase, all sales are final for membership periods already commenced, subject to ACL.


E. Made For More Mastermind (high-touch, limited-capacity)

Overview. A high-level mastermind with live coaching, hot seats, community, and resources.
Term & commitment. Minimum term as advertised (e.g., 6 or 12 months). By enrolling, you commit to the full term and payment obligation.
Refunds/cancellations. Due to limited capacity and the high-touch nature of delivery, cancellations are not permitted and fees are non-refundable, subject to ACL. Genuine hardship requests may be considered at our discretion.
Confidentiality. Peer and program confidentiality is expected; breach may result in removal without refund.


F. 1:1 Coaching (private mentoring)

Overview. Scheduled private strategy/mentoring sessions delivered via video conference or agreed method.
Rescheduling. Please provide at least 48 hours’ notice to reschedule; late cancellations/no-shows may forfeit the session at our discretion.
Refunds. Non-refundable once booked, subject to ACL.
Scope. Coaching is educational and strategic support; it is not legal, financial, medical, or psychological advice.


G. (Optional) AI Assistant / Custom-Trained Chatbot

Overview. Access to an AI assistant trained on MCC Education IP to support content and marketing workflows.
Access. Access commences on purchase and continues for the product’s lifetime while offered in its current format.
Refunds. All sales are final, subject to ACL.
IP & licence. Prompts, workflows and outputs are for your personal internal use. You must not resell, redistribute, or use them to train third-party AI without written permission.
Platform dependency. Availability depends on third-party AI infrastructure; if discontinued, we may sunset access without obligation to recreate the product.


FINAL ACKNOWLEDGEMENT

By completing a purchase, checking a box to agree, or accessing the Services, you:

  • Confirm you are at least 18 and have capacity to contract;

  • Agree to the Master Terms and the applicable Product Addendum;

  • Understand ongoing use constitutes acceptance of updated Terms as permitted above.
